TERMS AND CONDITIONS OF USE OF THE BIOMKET PLATFORM

1. General Information
BIOMKET is a platform operated by CAINMANI RESOURCES S.L., with VAT ID B72990377 and registered address at Calle San Telmo, 67, 28016, Madrid, and registered in the corresponding Commercial Registry (hereinafter, “BIOMKET” or the “Platform”). These Terms and Conditions govern access to and use of the www.biomket.com Platform, as well as the relationship between BIOMKET and the registered users (hereinafter, the “Users”) who wish to publish, buy, sell or manage organic waste through the intermediary system offered. Use of the Platform implies express acceptance of these conditions.
2. Purpose Of The Platform
BIOMKET is a digital tool that allows Users to offer, search for, buy or sell organic waste, facilitating contact between interested parties. BIOMKET does not act as a party in the transactions, does not own the waste and does not guarantee the execution of contracts between Users. Commercial operations are carried out directly between buyer and seller, under their sole responsibility.
3. User Registration
Full use of the Platform requires prior registration by the User, who must provide truthful, updated and complete information. Users may register as natural persons or as representatives of legal entities, provided they have sufficient legal capacity. Each User is responsible for maintaining the confidentiality of their password and for notifying BIOMKET of any misuse of their account. BIOMKET reserves the right to reject registrations, suspend or cancel accounts in case of breach of the conditions set forth herein.
4. Content Publication And Permitted Use
Users may publish advertisements about organic waste they offer or request. It is mandatory that this information be clear, accurate, not misleading, and comply with all applicable regulations, especially those relating to waste and the environment. It is expressly prohibited to:
- Publish illegal, hazardous items or those that infringe the rights of third parties.
- Include false, offensive, or discriminatory content.
- Use the Platform for purposes other than those authorized by BIOMKET.
- Contact other Users to close transactions outside the Platform, bypassing intermediary services.
BIOMKET reserves the right to moderate, suspend or delete any content that breaches these rules.
5. Relationship Between Users
The contractual relationship derived from each transaction is established exclusively between buyer and seller. Each party is responsible for complying with the agreed terms, including the quality of the waste, delivery, payment, taxes, environmental licenses, and any other applicable obligations. BIOMKET does not intervene in said relationship nor does it guarantee the execution, quality, delivery, or legality of the operations.
6. BIOMKET’s Role
BIOMKET acts solely as a technological intermediary that provides a digital tool to facilitate interaction between parties. It does not acquire, store, transport, or commercialize waste. BIOMKET may offer assistance, verification, or incident resolution functions, without this implying an assumption of responsibility for the outcome of the transaction.
7. Logistics Managed By Third Parties
BIOMKET may facilitate contact between Users and specialized logistics operators, upon request. However, the contracting and execution of the transport service is the sole responsibility of the User and the selected operator. BIOMKET shall not be responsible for transport incidents, late deliveries, losses, damages, or for the compliance with environmental or waste regulations by the carrier.
8. Fees
BIOMKET may apply fees for the use of certain services of the Platform, which will be previously communicated to the User. Continued use of the service after notification of the fees implies acceptance of them.
9. Invoicing
When the operation requires payment services, BIOMKET will use authorized entities, which will act as payment intermediaries. Invoicing of the waste is the responsibility of the seller. BIOMKET will only invoice for the services provided in its capacity as a digital intermediary, if applicable.
10. Intellectual Property Rights
The design, source code, images, texts, and logos of the Platform are the property of BIOMKET or its licensors. Their reproduction, distribution, transformation or any unauthorized use is prohibited. Likewise, content generated by Users must respect the rights of third parties. BIOMKET may remove content that infringes copyright or trademarks.
11. Account Suspension And Cancellation
BIOMKET may suspend or cancel a User’s access in case of breach of these Terms and Conditions, fraudulent use, fee evasion, publication of prohibited content, or infringement of other Users’ rights. The User may also unsubscribe freely by notifying via email or from their control panel.
12. Limitation Of Liability
BIOMKET shall not be responsible for:
- The quality, legality, or truthfulness of the waste offered.
- Non-compliance by Users with applicable legislation.
- Economic or business losses derived from the use of the Platform.
- Technical failures, interruptions or system errors.
BIOMKET has adopted reasonable technical security measures, although it cannot guarantee the absence of technological risks inherent to the digital environment.
13. Modifications
BIOMKET reserves the right to modify these Terms and Conditions. Changes will be communicated through the Platform or by email. Continued use of the services implies acceptance of the updated conditions.
14. Applicable Law And Jurisdiction
These Terms and Conditions are governed by Spanish law. In case of dispute between BIOMKET and the User, both parties agree to submit to the Courts and Tribunals of the city of Madrid, unless consumer and user regulations determine otherwise.
